Pool Service Agreement

TOTALCARE POOL WEEKLY POOL SERVICE AGREEMENT

CUSTOMER PLAN

The Customer has selected the Month-to-Month plan at $180.00 per month, plus applicable chemicals, repairs, parts, materials, specialty services, and taxes.

WHAT TO EXPECT

• You will receive a call from our office to confirm payment details and schedule your onsite inspection, if not already completed.

• An inspection is performed before recurring service begins.

• If repairs, water chemistry corrections, or cleanup are required beyond routine weekly maintenance, TotalCare Pool will communicate its recommendations. Any work requiring Customer approval under the Repairs and Chemical Treatments section of this Agreement will be submitted for approval before the work is performed.

• Once the pool and equipment meet service standards, recurring weekly maintenance will begin.

SERVICE PLAN TERMS

MONTH-TO-MONTH SERVICE

The Month-to-Month Service plan provides flexible monthly service without a long-term commitment. Service may be canceled at any time in accordance with the Cancellation and Term section of this Agreement.

The Month-to-Month Service rate is not rate protected. TotalCare Pool may adjust the monthly service rate because of market conditions, labor costs, service requirements, or other business conditions.

Any change to the Month-to-Month Service rate will be provided in writing with a minimum of fourteen (14) days’ notice.

12-MONTH SERVICE RATE

The 12-Month Service Rate is a discounted monthly rate provided in exchange for a twelve (12) month service commitment.

The monthly service rate selected at the beginning of each 12-month term is guaranteed and will not increase during that term.

Rate protection applies only to the regular monthly weekly service fee. Chemicals, chlorine tablets, repairs, specialty maintenance, parts, materials, additional services, taxes, and other separately billed items are not included in the rate protection.

Renewal and cancellation terms for the 12-Month Service Rate are described in the Cancellation and Term section of this Agreement.

Only the terms applicable to the plan identified in the Customer Plan section apply to the Customer.

FIRST MONTH FREE PROMOTION

The First Month Free promotion is available only to new TotalCare Pool weekly service customers.

Eligible new customers will receive a one-time statement credit equal to the monthly service fee for the service plan selected under this Agreement. The credit will be applied toward the Customer’s first monthly service charge.

Chemicals, repairs, specialty maintenance, parts, materials, taxes, and other additional services are not included in the promotional credit and will be billed normally.

Existing customers using this Agreement to update or continue service are not eligible for the First Month Free promotional credit unless specifically authorized in writing by TotalCare Pool.

WEEKLY SERVICE INCLUDES

• Brushing walls, steps, and seating areas

• Vacuuming as needed

• Emptying skimmer and pump baskets

• Water testing and chemical balancing

• Backwashing sand filters, if applicable

Chlorine tablets for non-saltwater pools are billed separately at the current retail store sale price, less a 10% weekly service customer discount, and charged to the Payment Method on file.

NO GREEN GUARANTEE

TotalCare Pool stands behind its service with the No Green Guarantee. If the Customer’s pool turns green while under regular weekly service, TotalCare Pool will restore water clarity at no additional labor cost. The Customer is responsible for the chemicals used to restore the water.

This guarantee applies provided that:

• The pool has remained on uninterrupted weekly service.

• All recommended repairs have been approved or completed.

• Proper circulation run times have been maintained.

• The water level has been kept at the proper operating height.

• No outside chemicals have been added without consultation.

• Pool equipment is functioning properly.

• Recommended water chemistry corrections, such as draining for high stabilizer or hardness, have not been declined.

Chemicals required for recovery and extraordinary conditions such as severe storms, equipment failure, excessive debris, or other environmental factors may still be billed when applicable.

SPECIALTY MAINTENANCE

When applicable:

• Cartridge and DE filter cleaning every three months: $129

• Salt system cleaning every three months: $129

• Homes with both systems receive 50% off the second service.

Specialty maintenance pricing may change based on material or service costs. Updated pricing will be communicated at least fourteen (14) days before the service is performed.

REPAIRS AND CHEMICAL TREATMENTS

TotalCare Pool may complete minor repairs and routine chemical treatments costing $100 or less without prior approval and bill the Payment Method on file.

• Repairs exceeding $100 require Customer approval before work is performed.

• Chemical treatments exceeding $100 require Customer approval before work is performed.

All completed services, chemicals, parts, and materials are payable upon completion.

BILLING AND PAYMENT

For purposes of this Agreement, a “month” means a calendar month beginning on the first day and ending on the last day of that same calendar month.

• Billing occurs on the first of each month for the previous month of weekly service.

• Billing for chlorine tablets, filter cleanings, salt cell cleanings, repairs, chemicals, and other separately billed items occurs at the time of service.

• AutoPay enrollment is required.

• A valid Payment Method must remain on file at all times.

• If payment is declined and not resolved within seven (7) days, service will be paused until the account is brought current.

ACCESS, EQUIPMENT, AND SERVICE REQUIREMENTS

• Access pathways must provide a minimum of 30 inches of unobstructed width.

• Missed visits caused by restricted access are not refundable.

• Pool covers must be fully removed before service. If a cover remains in place, service may be limited to basket service only.

• The water level must be maintained at mid-skimmer height.

• Pets must be secured during service visits.

• Pool equipment must remain in safe and operable condition.

CIRCULATION REQUIREMENTS

Pool circulation should operate approximately one hour for every 10 degrees of daily high temperature unless otherwise recommended by TotalCare Pool.

If essential pool equipment is unsafe, inoperable, or unable to support proper circulation or sanitation, TotalCare Pool may recommend repairs or corrective action.

If essential repairs or corrective actions are declined or not completed, TotalCare Pool may pause or terminate service until proper operating conditions are restored.

ENVIRONMENTAL AND USAGE FACTORS

Arizona weather conditions, including heat, dust, and monsoons, may temporarily affect water clarity.

Additional services such as partial draining, stabilizer reduction, phosphate treatment, storm cleanup, or recovery from neglect may be required and billed separately.

WATER CHEMISTRY CONDITIONS BEYOND OUR CONTROL

Conditions that may require additional service or charges include:

• High calcium hardness requiring dilution or draining to prevent scaling.

• Elevated stabilizer, also known as Cyanuric Acid or CYA, requiring dilution or draining.

• High phosphates requiring treatment to help prevent algae growth.

If recommended corrective actions are declined:

• Water clarity may not be guaranteed.

• Additional chemical charges may apply.

• Service may be paused until proper conditions are restored.

TotalCare Pool is not responsible for staining, scaling, plaster wear, or equipment damage resulting from existing or uncorrected water chemistry conditions.

SPECIAL USAGE CONDITIONS

Pools with frequent swimming dogs or unusually high bather loads may require additional chemical treatment billed separately.

Pools requiring cleanup beyond normal weekly maintenance because of storms, construction, heavy use, landscaping debris, or neglect may require additional service charges.

If essential corrective actions are declined, TotalCare Pool may pause or terminate service until proper operating conditions are restored.

HOLIDAYS AND INCLEMENT WEATHER

If service falls on a major holiday or between December 25 and January 1, service may be rescheduled if needed at no charge. Otherwise, service will resume on the next regularly scheduled service day.

During lightning or heavy rain, service may be limited to chemical balancing and basket clearing for safety.

The TotalCare Pool office closes annually from December 25 through January 2. Response times may be delayed during this period.

CANCELLATION AND TERM

MONTH-TO-MONTH SERVICE

Customers enrolled in the Month-to-Month Service plan may cancel service at any time.

The Customer remains responsible for all services performed, chemicals used, parts and materials provided, and other charges incurred through the effective date of cancellation.

12-MONTH SERVICE RATE

Customers who select the 12-Month Service Rate agree to maintain recurring weekly pool service for twelve (12) consecutive months.

At the end of each 12-month term, the Agreement will automatically renew for an additional twelve (12) month term at TotalCare Pool’s then-current 12-Month Service Rate unless the Customer provides timely notice of non-renewal.

TotalCare Pool will provide written notice of the renewal rate and upcoming renewal at least forty-five (45) days before the end of the current 12-month term.

The Customer may prevent automatic renewal by providing written notice to TotalCare Pool at least thirty (30) days before the end of the current 12-month term.

If the Customer does not provide timely notice of non-renewal, the Agreement will automatically renew for an additional twelve (12) month term.

Once a new 12-month term begins, the monthly service rate for that term will remain protected from increases for the duration of the term.

EARLY CANCELLATION OF A 12-MONTH TERM

If the Customer cancels during an active 12-month term, the Customer will be responsible for paying the difference between the discounted 12-Month Service Rate and the Month-to-Month Service rate offered to the Customer at the beginning of that 12-month term for each month or partial month of service received before cancellation.

This rate adjustment is intended only to recover the discount the Customer received in exchange for the 12-month commitment and is not an additional cancellation penalty.

If TotalCare Pool terminates service before completion of a 12-month term for reasons not caused by the Customer, the Customer will not be responsible for repayment of the discounted rate difference.

TOTALCARE POOL’S RIGHT TO PAUSE OR TERMINATE SERVICE

TotalCare Pool may pause or terminate service if:

• The account becomes delinquent.

• Required access is not provided.

• Pool equipment is unsafe or inoperable.

• Necessary repairs or corrective actions are declined.

• The Customer fails to meet the service requirements contained in this Agreement.

• Other conditions prevent TotalCare Pool from safely or reasonably providing service.

The Customer remains responsible for payment of all services performed, chemicals used, parts and materials provided, and any applicable rate adjustment through the effective date of termination.

By signing electronically, the Customer acknowledges that they have reviewed and agree to the terms of this Agreement, including the service plan identified in the Customer Plan section, and authorizes TotalCare Pool to provide and bill for services as described.
